Denton HOA and Landlord Sue Developer Over Sewage Spill

A Denton homeowners association and a nearby shopping center owner are filing lawsuits against a construction firm after raw sewage killed hundreds of fish in 2025.

The Wind River Estates Homeowners Association and the owner of the adjacent Southridge Village shopping center are pursuing legal action against Jordan Foster Construction following a July 2025 sewage spill. The incident occurred when a worker at an apartment construction site mistakenly dumped raw waste into a storm drain that flowed into two neighborhood retention ponds, killing hundreds of fish.

HOA President Mike McCormick stated that the developer offered only $15,000 during mediation, which he described as significantly less than the estimated $75,000 needed for repairs. McCormick plans to file suit after the offer was rejected. Ed Wolski, the shopping center owner, is also preparing to litigate, having received no response to his requests for cost coverage.

While city officials maintain that water quality is safe, residents remain concerned about ongoing sediment issues. Both parties seek full compensation for damages, including pond restoration and fish replacement, as details regarding the exact financial settlement remain unclear.
